{"id":1882,"date":"2017-05-02T16:04:00","date_gmt":"2017-05-02T20:04:00","guid":{"rendered":"https:\/\/blog.uvm.edu\/cap\/?p=1882"},"modified":"2024-11-18T16:48:38","modified_gmt":"2024-11-18T21:48:38","slug":"cause-related-marketing","status":"publish","type":"post","link":"https:\/\/blog.uvm.edu\/cap\/cause-related-marketing\/","title":{"rendered":"Cause-related Marketing"},"content":{"rendered":"\n<p><strong>Who has to follow this law?<\/strong><br \/>The law applies only to for-profit entities that are \u201cregularly and primarily engaged in trade or commerce\u201d \u2013 these are called \u201ccommercial co-venturers.\u201d The law does not apply to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Nonprofits or religious or fraternal organizations<\/li>\n\n\n\n<li>Professional charitable fundraisers<\/li>\n\n\n\n<li>Individuals who normally work in one industry but, on a limited basis unrelated to their normal activities, are undertaking a charitable sales promotion.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p><em>Example: Rebecca is an energy consultant, but every fall she sells pies at the local famers\u2019 market.&nbsp; This year, she is raising money for building schools in Haiti.&nbsp; She can say a portion of her profit from the pies will go to building schools, but she does not have to follow all of the disclosure and record-keeping requirements because this is not her regular and primary job.<\/em><\/p>\n\n\n\n<p><strong>Are there any promotions where I don\u2019t need to give full disclosure or keep records?<\/strong><br \/>A commercial co-venturer does not have to provide full disclosure and keep records if:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>One-hundred percent of the amount a consumer pays for the good or service goes to the charity.<\/li>\n\n\n\n<li>The co-venturer does not generate a net profit from the promotion.<br \/><em>Allen\u2019s Market is raising money for veterans.&nbsp; It buys and prints t-shirts for Memorial Day.&nbsp; After recouping the cost of the shirts and printing, Allen\u2019s donates the remaining money to a veterans\u2019 cause.<\/em><\/li>\n\n\n\n<li>The co-venturer does not advertise that any amount of the purchase price of a good or service will go to a charitable cause. &nbsp;<br \/><em>Newport Sporting Goods always donates to the annual Lake Swim, but does not advertise that the purchase of any particular product or service will increase or affect the amount of the donation.<\/em><\/li>\n\n\n\n<li>The promotion does not involve the sale or lease of goods or services. &nbsp;<br \/><em>\u201cMt.
